No chance of damage??
>Backup or archival copies of your games stored on a cart, CD, or optical disk are not legalized because they have hardly any chance of being damaged beyond repair.

Well, I know this guy is only talking about "NEW" GBA games, but he certainly hasn't seen my old NES carts, they're simply unplayable! That goes for my old NES as well! So how can I believe that is the only reason ROMs are illegal? It's simply about copyright laws. That is why Hollywood studios burn up and last copies of old movies when the copyright expires. It's all about greed people, simple greed.

i agree with big brother as long as nintendo keeps charging such obscene prices for their games then they deserve to be ripped off here and there.

look at the gamecube, they are using optical discs and with the packaging included it will probably cost them around 13 cents a game, so of course they will charge around 59$ for a new game so with tax your paying 65$ on a 13 cent disc and getting it up the ass.

dont get me wrong i love nintendo games, but for the love of god they are some real greedy bastards that make them. and if they want to waste time and money tracking down 'illegal roms' then they need to get their heads out of their asses because as i speak a billion people in china are making illegal copies of everything known to man.

Wow, real intelligent convesasions :) going on here...
I own a GBA. I own an snes. An nes, a genesis, a 64, a ps, and a Gbp.

I have emulators for: GBA, Snes, nes, genisis, Ps (yay) and gb.
I have illegal roms for snes, nes, genisis, and gameboy.
The roms are for systems who no long work, are sold, or have new software for them. people who get roms for new systems have a problem. Not a moral or ethical one, but the fact that you just can't
emulate the feeling of playing the real thing.

Emulators have nothing to do with copywrite infringment (sp?)
the peole who use them for the wrong purposes do.

oh, lighten up, ya dick weeds, it's not like anyone is making money off of this.

Hey poopoo platter, I think you forgot the fact that all those people who worked on a game want to live and to be paid, too! There are lot's of programmers, designers and componists, and they need to live from those games!
A game is worth lot lot more that only 13 cents!

Re: A note
You've been studying law for quite some time...yet you can't even spell "legal". Now, I am not denying that you have studied law, or questioning your credibility, but it seems strange to me that over these "eons" of studying (and I am assuming taking classes), you have not come across the word "legal" and noticed that you have been spelling it incorrectly. Tell me now, what law school did you attend?

Moreover, capitalizing it...I, on the other hand, do doubt your credibility....I will continue to doubt it until you prove otherwise (which you won't)...so we can take another geek's 'facts' on this matter and add them to the rest of the stuff they read somewhere else...and try to pass off as valid information earned through any means of proper education. Here's waiting for the proof....if, somehow, you do prove that you've studied law...I won't retract my comment...because, quite frankly...I don't really care....the fact of the matter is you spelled one of the main words used in your profession/courses of education...and for that...you're an idiot. Spelling it incorrectly is one thing...capitalizing it is another...nice try...sign off and take a bath, squirt.

re: gba roms are illegal
If you are only purchasing a liscense to play the game, how come it's legal to sell your games and how come it's legal for second hand shops to sell games that they have bought of someone such as yourself. Explain that.

Wow, the amount of brains in this thread is amazing
KowKow: i expect that kind of a response from my 6-year old. Maybe you're a friend from his class at school??

i seriously doubt anyone who's posted here knows what they're talking about one way or the other. The ones who say copying a game AT ALL is illegal, you need to go back and study some more. You're obviously confused by our complex and intricate laws.

The ones who say copying a ROM if you own it is legal don't even claim to have a source for why they say that. If you haven't read the laws on it thouroughly, don't post like you know what you're talking about. How is it any better for you to post because it's "general concensus" than the other morons who are going off license agreements and badly-interpreted law?

In short, ya'll shutup now, ya'here?

"theguythatkilledyourmother": Oh boy, are you a dumbass. Unlike you, when i find a word which i'm not quite sure about, i like to look it up on dictionary.com BEFORE i stick my foot in my mouth:

solicitor \So*lic"it*or\, n. [F. soliciteur, L. solicitator.] 1. One who solicits.

2. (Law) (a) An attorney or advocate; one who represents another in court; -- formerly, in English practice, the professional designation of a person admitted to practice in a court of chancery or equity. See the Note under Attorney. (b) The law officer of a city, town, department, or government; as, the city solicitor; the solicitor of the treasury.

Oops! Don't you feel like a jackass now? That's what you get for learning most of what you know from signs posted at WalMart.

Re: Owning GBA ROMS... blah blah blah
Okay, this is ridiculous. Can anyone give direct information about the legality of ROMS and emulators? If it is an internet source please only specify information off of government websites (of course give URL's). Just because Nintendo says its illegal doesn't mean that it is.

My, arent we lacking in morals?
I would like to express my pesonal opinion that you are all quite large morons, with a rare exception for a few of you.

First, cussing at those you are attempting to debate with is not going to gain you leeway, its going to make you look like a 10 year old who thinks cussing makes you cool. It's going to show your inabliblity to think. It's going to make you look dumb. You don't want to look dumb, you want to sound intellgent so people get pissed because they think you are smarter then them, not because you cussed mornoicly in their general direction.

Second, it seems rather pointless to debate what the law is in this situation, because most of you are probobly ignoring them anyways so you can pirate console games. Whee. Though it makes for an interesting debate, givin you don't go and make an ass of yourself.

Now i would be a hypocrit if i did'nt say the following

I admit openly that i have downloaded roms that i did'nt own before, but i don't do it because i dont' want to pay for the game, i do it because i want to know if the game is worth playing.

For instance, GOLDEN SUN comes out for the Game Boy Advance on nov. 13, and i have been quite interested in buying this game for a while. However, i don't want to buy a game, and find out that i don't like it, because my intrest in video games has dropped in the last few years, so if i spend money, i want to enjoy what i spend it on. So what did i do? I found a rom and an Emulator off of the internet, installed, and ran the game, and played it for about a half hour. I Enjoyed it. Conclusion: Buy the game. From there i delete the rom, the emulator, and get on with my life. For me, it's more of a trial system, because if i play the whole game, and don't buy it, i'm taking money from the people who make the game that i liked, and if they don't have the few dollers they get from me buyint their product, they have just that much less money to make more products that i might be interested in.

NOw i know at least one of you is going to say somthing along the lines of: "OH, but wait! They're a big company Sean! They already make Assloads of money! What's me taking one little sale away from them going to hurt them? The can give away some money! They can afford it!"

Okay, fine, if it was just you, they proboly wouldent notice, however, it's not just you, is it? there are hundreds of emulation websites out there, that get thousands of hits, showing a great deal of piriacy out there, this adds up in money that COULD have been spent to support the company. Besides, turn it around,if you invented a program that was very popular, and you discoverd that over a million people were pirating it, costing you millions of dollers, wouldent you be in the slightest pissed off? (If a company makes 10 dollers profit per game they sell, and 1 million gamers pirate the game rather then buy it, that's 10 million dollers in lost profits)

I swear, morals of kids these days. I got into an arugement with a aqauintence of mine the other day, whonm thought that microsoft was an 'evil' company because the re-designed the new windows with anit-piracy software, making it near impossible to pirate the product, trying to gain my sympathy because his frined got arrested for stealing sombody elses product serial number and trying to register it with a burned CD. MICROSOFT as a company has a right to protect their intrest. It's just good bussiness.

Nevermind, somebody is probobly gong to try and flame me now, either cussing to much, or pretending like they never do.

IN acny case, i don't even know where this board is, i just wanted to put in my two cents.

If you want to reply, email me at

Later.

You all are quite stupid. I'm sorry you have to be so ignorant.

Re: hahahahahahahah
Oh brother. I just love little b.i.t.c.h. posts like this.

My two cents, believe it or not.

For anyone that reads in a manual that it is illegal to copy that game AND you believe it then for whatever reason you seem to think nintendo is above the law. Nintendo or any other manufacture DO NOT MAKE LAWS!

Now OF COURSE I dont remember the EXACT number to the EXACT section but a consumer rights act was past way back when that allows a consumer to protect their investment.

Bottom Line:
If Nintendo offers free replacement of there cartridges then and only then can they validate their claim that the consumer is NOT to make any duplication of the product. However if no such replacement is available then the consumer is well beyond their rights to backup their investment all they want.

That goes for software and music.

Now I also know that it was appended due to a rise in consumer product volumes. It was then extended to the fact that if a "fair and reasonable" replace charge (restricted to materials only) is offered then again the manufacture may make claim to no allowed duplications.

Now how does this get interpreted into someone making a "backup" of a cart they actualy own and then playing it on a emulator? I have no firggen clue.

Example: GBA
My $35 dollars goes to a GAME. There is no stipulation that the game MUST be played on a GBA. Sounds legal to me if I decide to play my new game on a different machine. Nintendo's only gripe would be they lost the sale of the GBA. BOO FRIGGEN HOO!

Re: hahahahahahahah
Oh and as for the 13 cents per game and the 50 bucks they charge:

Do you have any friggen clue as to much game development costs? All you see is a 2 dollar package sitting on a shelf and you think you should only have to pay the 2 dollars. Games can cost up to a million dollars and keep on going depending on the content.

I'm going to get a little crazy and use an example such as Final Fantasy X.

Over a hundred people worked on that project and if you use a SMALL average like $30,000 a year for each person that worked on it (which is actually way to low) times the length it took to product the game that's over 5 million dollars. AND THAT'S JUST PAYROLL!!!!!!!!!!!!!!

Just to get payroll back @ $50 a game would be 100,000 copies. And like I mentioned that number to begin with is way to low. AND that number is probably about 5% of the actual cost in the scheme of making that game.

Then there is distribution. Imagine every single truck that delivers the game packages to all the stores. But first imagine the actual number of stores that are out there. This is another neat little incite. Sony does NOT pay to get the game to the store. They pay to get the game to the stores distribution center. BUT WAIT... The store buys the game then pays to have it shipped to their own stores from their own distribution centers? How can they afford that???? Because they didn't buy the game for $50! That's right! Sony is not even making the full shelf price of the game!!!!!!!!!!!!!! The store bought it for less then that and was still able to ship to their own store AND WAS STILL able to make money off of it.

Sony probably sees about 30 dollars of each unit sold. AND after they are done paying all the employees and paying to have the packages made and paying for all the utilities that drive the Sony Production Studios and all the paper and materials that where used I bet 2-4 dollars per unit sold is all they see for profit.

Making money is the name of the game and Sony and all other businesses are well within their rights to do as such. Don't like the price? Don't buy the game. You can b.i.t.c.h. all you want but you just look like an uneducated idiot doing it.

And dont friggen reply saying that the games cost $60! Because they do come down in price and then the average price per game really becomes $55 after a few years and well FIVE ZERO was much easier to do math with.
