Final Draft of the New Constitution is released.
Draft Royal Constitution
of the
Kingdom of Alteria.
PREAMBLE
When every nation, in the course of time, endeavours to protect its valued beliefs, those beliefs are in one form or another enshrined. Bearing this is mind, recognising the supremacy of God and of the law, the ROYAL CONSTITUTION of the Kingdom of ALTERIA is thus ordained.
Part I
Freedoms and Rights of Citizens
1. Every citizen of the Kingdom of Alteria, by birth or naturalisation, regardless of age, gender, race, ethnic origin, religion or disability, have the following fundamental rights within reasonable limits.
(a) freedom of conscience and religion;
(b) freedom of thought, belief, opinion, and expression. This includes freedom of the press, and other media of communication;
(c) freedom of peaceful assembly; and
(d) freedom of association.
2. Every citizen has the right to vote in elections, and to be a member of the National Alterian Council providing they meet the requirements of the above stated Houses of Parliament.
3. Every citizen of the Kingdom of Alteria (hereafter stated as Alteria) has the right to
remain in, leave, enter and travel through Alteria at his or her own discretion. Furthermore,
every citizen of Alteria has the right to settle in any area of the country where they can obtain
residence.
4. Every citizen has the right to security of person and property, and the right to be deprived of these only through the process of justice that is prevalent in a free society.
5. No citizen may be searched or have property seized without reasonable grounds as approved by a court of law.
6. Every citizen who is arrested has the right to be informed of the charges laid against him or her, and furthermore have the right to be brought to trial on the charge in a reasonable amount of time.
7. No citizen shall be convicted of a felony except by a Royal Judge, (with or without the consultation of a jury of citizens, consisting of five (5) members), or the Monarch.
8. Every citizen has the right to be considered innocent of a stated charge, until such time as the
citizen is proven guilty in a Royal Court, and to be treated equally to any other citizen under the
law.
9. Every citizen has the right to appeal to the Monarch before his or her (second) appeal begins.
10. Every citizen has the right to an appropriate sentence, without cruel and unusual punishment,
including a method of execution that inflicts minimum suffering and humiliation in cases where such penalty is ordered.
Part II
The Government
The government shall be created by popular decision (not less than once every year), and by the
discernment of the Monarch and for the betterment of the nation and the lives of the citizens.
1. Popular legislative power shall be vested in the National Alterian Council, a parliament, composed of a One House of Parliament.
(a) Members shall have been citizens for at least three (3) months before the day of voting.
(b) Of all the candidates, the ten (10) who secure the most votes shall be declared elected.
(c) Members who are elected shall bear the title the Honourable (name), Member of National Assembly.
(d) All representatives elected shall serve a sixth month term, after which writs of election shall be issued.
Responsibilities:
(e) The National Alterian Council shall create legislation for the benefit of the people, and shall act as the commoners’ voice in government.
(f) The National Alterian Council is responsible for the election of its officers, namely the speaker, his or her deputy, and the Reporter.
(g) The Monarch must approve all bills passed by the National Alterian Council.
3. The Monarch retains the power of dismissal of members of the National Alterian Council.
4. The Prime Minister shall be appointed solely by the Monarch, and shall be in charge of the daily operations of the Kingdom. As executive, he or she may (with the consent of the Monarch) appoint Ministers of the Crown, and create new Crown Ministries. It is generally accepted that the Prime Minister should be a member of National Alterian Council.
5. Before taking office, all members of government shall swear/affirm the following
oath/declaration: I swear/affirm that I, (name) will be faithful and bear true allegiance to His/Her Royal Majesty (name of current monarch), King/Queen of Alteria, His/Her appointed delegates, Heirs and Successors, and that I will faithfully observe the laws of Alteria and fulfil my duties as a member of His/Her Royal Majesty’s government.
Part III
The Monarchy
The Kingdom of Alteria was founded on the belief that a strong, kind, caring, leader is the
basis for any successful society, and as such, the Monarch is supreme head of the Kingdom.
1. The word of the Monarch is law, (and in necassary circumstances) superior to this
document. Royal Decrees cannot be overturned, and do not need ratification by the
National Alterian Council.
2. The Monarch shall bear the title "His/Her Royal Majesty, King/Queen of Alteria"
3. HRM is to be treated with extreme respect, and shall be addressed as "Your Royal Majesty"
or "Your Majesty".
4. A successor shall be appointed by the Monarch before the end of his or her reign. If
none has been appointed, the succession shall be determined as per the law of the Kingdom of Alteria.
5. The Monarch shall be responsible for summoning, overseeing, and dissolving the
National Alterian Council(from here on known as the NAC. Furthermore, the Monarch must approve all bills passed by the NAC. Power to make war and peace, authorize and overturn treaties, issue Letters of Credence, and appoint Crown Ministers (including the Prime Minister) is goven to the Monarch. The right to counsel, encourage, and warn, as well as all residual powers are
also vested in the Monarch.
Part IV
The Judiciary
1. The role of the Judiciary shall be to enforce and apply the Statutes of the National
Alterian Council, and the Criminal Code.
2. The Judiciary shall be comprised of three (3) levels. The Court of the King’s Bench,
The Royal Court of Appeal, and the Royal Legal Council.
3. All Royal Judges and Royal Legal Councillors shall be appointed by the Monarch.
4. Decisions of each level may be appealed to the next higher level, and a re-trial may
be granted, should the next higher level agree to hear the case.
Part V
Amendments
1. In order to amend this Constitution, two-thirds (2/3) of the National Alterian Council must be in favour of the proposed amendment.
2. After the Amendment is approved by either the NAC, two-thirds (2/3) of the
population of Alteria must declare their favour in a national Vote.
3. Should the Population accept the proposed amendment, the Monarch must then
approve or reject the desired change.
