Re: LONG LIVE KARL MARX!
So the Second Plank of the Communist Manifesto (A heavy or progressive income tax) is okay?
As George Washington said "The Government has no more a right to stick its hand in my pocket, than I do to stick my hand in my neighbors pocket".
An income tax is wrong in a free society. The government does just fine raising money Constitutionally, i.e. excise, duties and tariffs, and if for some reason, they fall short, they can then go to the states to make up the difference, but it must be collected apportioned to population!
Plus, the Federal Government and its agencies are not authorized to operate outside of the jurisdiction of the District Of Columbia (see Article 1, Section 8, Clause 17) to verfiy this. Why do you think there is a District of Columbia?
What he have in America is not a government of the people, for the people, and by the people, but an Aristocracy. The "elite" in Congress rule over the people with ruthless tactics. How can we be free when a gestapo like federal agencies sieze property at will and send people of to be "re-educated" in prison for not paying tribute to this ruling class? We have gone from the masters of our government to feudal slaves, toiling 5 months a year to give a portion of our productivity to our masters. This is tyranny.
Do we have a Constitution, with Constitutional law or don't we?
Before 1913, when the Sixteenth Amendment was fraudulently passed, the Federal Government operated with an enormous surplus, collecting taxes Constitutionally.
A call for the return to constitutional government is perhaps not so much revolutionary as it is a demand for restoration. A restoration of the supremacy of the individual over the collective, of the state over the federal and, more generally, of the rule of law, not men. It is unfortunate that the current U.S. government has abandoned these principles to the point that such a restoration will require great sacrifices on the part of those who would bring it about.
Last week, I explained how violent acts of revolution would be self-defeating. This week, I have a few suggestions which are not only justifiable for men of conscience and good will, but also will help bring about the restoration of lawful constitutional government in America. The good news is that because the government's behavior is so often outside the law, the legalities are usually on our side. The bad news, of course, is that most officials prefer the status quo to enforcing the law as written.
A hallmark of totalitarian government is to co-opt those who passively oppose the enterprise by forcing them to participate in the process, which allows those in power to claim that their right to rule is legitimate. Striking at this pretense is paramount, therefore, it is imperative that patriotic American Restorationists refuse to take part in the corrupt fraud that is the federal election process. It will be very difficult to claim democratic legitimacy if the vast majority of the people refuse to take part.
Another related tactic is one I have mentioned before. The former Bureau of Internal Revenue, Puerto Rico, now known as the IRS, has successfully conned most Americans into believing that they have a responsibility to pay federal income taxes. Most do not, because very few Americans are residents of the federal United States, being instead residents of a sovereign state which is a member of the United States of America. The fact that a few corrupt judges disagree with this is of no account – look up the law and read it for yourself if you do not believe me. Then act accordingly, which for most of you means to claim exempt and stop filing.
A third step is to hammer those third parties who act as virtual agents for the federal government. Not only are you not required by law to provide your social security number in order to open a bank account or visit a doctor, but they are legally banned from asking for it. The tax reform act of 1976 and Title 42, chapter 7, subchapter II, sec. 408 (a)( , make it a felony for any agency or instrumentality to require the disclosure of such a number, punishable with up to a one-million dollar fine, censorship, five years in prison, or a combination thereof. So, every time someone demands your SSN, call the cops on them.
Because the investment and banking systems have been inextricably tied to the IRS reporting systems, take your money out of them. Buy gold, physical gold. The government hates this, which is why FDR banned private ownership of it in 1933. It would be even better if individuals began accepting it as an alternate means of payment for goods and services. In any case, it's not a bad investment right now.
Read up on the laws regarding your local officials. In Oregon, more than half of the state's circuit court judges appear to be illegitimate since they've never taken the required oath of office. Check your state constitution to learn if one is required – if it is, see if the judges' oaths are on file with your secretary of state. This is a good and lawful way to eliminate the worst federalist whores. After all, your Honor, ignorance of the law is no excuse!
If you don't have a gun, buy one. If you've got one, buy one for someone else.
Now, these six suggestions may seem like petty pinpricks to the gargantuan colossus that is the federal government, but it's not as if dumping a shipload of tea into Boston Harbor shook King George's throne ... at first. Government is a fragile beast, and I have no doubt that these actions, if acted upon by a dedicated few, will begin to bring about the freedom and lawful rule we seek.
If 700,000 pot smokers are willing to be arrested for their cause every year, then how much more should we, the sons of American liberty, be willing to risk for ours?
Quote: Plus, the Federal Government and its agencies are not authorized to operate outside of the jurisdiction of the District Of Columbia (see Article 1, Section 8, Clause 17) to verfiy this.
Wrong again. That gives Congress complete legislative authority over the District, (which they have ceded in part to the City government), but does not prevent clauses 1, 3, 6, 7 and 18 from applying in other jurisdictions.
Quote: Why do you think there is a District of Columbia?
It seemed like a good idea at the time, but it probably should be given back to MD.
Those powers enumerated in Article 1, Section 8 are the only powers the federal government has outside of its jurisdiction. Anything else it is doing is UnConstitutional!
The Tenth Amendment to the Constitution tells us that any other power not given to the government in section 8 is reserved to the states, and then ulitmately to the people.
The Senate needed at least 36 states to ratify (there were 48 in 1913).
In order for an Amendment to be ratified by a state, it needs to come back to Congress worded EXACTLY as they recieved it with either a yea, or a nay.
A state CANNOT change wording, punctuation, or structure otherwise their submission is void. Several states that thought they ratified the Amendment didn't because they changed the wording, or punctuation to make it Constitutional. This voided their submission.
But is this really the issue? What if the US decided to reinstitute slavery, and sent the proposed Amendment to the states for ratification. Even if the required states propertly ratified the Amendment, It would certainly be legal but would it make it right?????
In Europe throughout the last millenium, people were ruled by monarchs. Most countries were feudal. You had the peasants, and you had the ruling class.
The ruling class didn't do a days labor for their riches, they just took from the peasants, at will.
In those days nobles owned the land, and they allowed peasants, or commoners to live and work the land. Sure, there was a sense of freedom for these people, but in order to live and work the land, they had to pay tribute to their noble landlord.
These landlords would require either money or product as payment. If you didn't pay, your house was burned and you were thrown off the land.
The founders hated this form of society. They made sure that the people would never be ruled by such nobility. So, in our Constitution, they guaranteed that every single man, woman and child, regardless of national origin, or economic status was a king among kings. The government was a neccessary evil, but the contraints of the Constitution would keep this government as a servant instead of the master.
But in 1913, the Constitution was turned on its ear. The power was shifted from the people to the government, and the new ruling class was born....CONGRESS.
Leading up to the 20th Century, it was common to see ordinary men, sometimes with only good character, holding public office, now, it is made up almost entirely of the ultra rich. These people have become our Aristocrats, and we their peasants. They keep extracting our labor to benefit themselves.
Now the people have been turned into economic slaves. Our master is now the government. We toil to pay our master, year after year after year. If we don't pay our tribute, he comes and takes our homes and belongings and throws us into prison as punishment. How in the world can someone with any sense of American pride, put up with this???? Especially knowing that it is not part of our organic Constitution?
Its America's lack of knowledge of our very own Constitution and the spirit of that Constitution that keeps us enslaved. The government doesn't need our tax money. Virtually all of the taxes collected each year goes to pay the national debt.
What is the national debt? The national debt is not a debt we owe ourselves. It is a debt we owe the Federal Reserve. They print money everyday, and sell it to the government at face value. It cost a mere 4 cents to print a bill, regardless of the denomination. Yet, the Federal Reserve Banks loan that money to the government at face vaule plus interest. This is called usury and it is illegal.
The Federal Reserve IS NOT part of the government. It is a private banking corporation. Congress is addicted to this system of loans. They borrow from the Federal Reserve, and then make us pay back the loans.
What if Microsoft were to get the Congress to make a law saying that the only computers in the US that can be bought and sold had to come from Microsoft?? How long would this law last? This is EXACTLY what the bankers did in 1911, headed by JP Morgan, Rockefeller, Nelson Aldrich, and a few other bankers, they created the Federal Reserve at the Rockefeller resort home on Jeykll Island, Georgia. They created a banking and monetary monopoly and had it signed by Congressmen who were on the take.
The Constitution only authorizes Congress to print and coin money and no one else.
If you enjoy being an economic slave, paying your master, then I won't stop you, but don't force me into it.
Too many people went muzzle to muzzle to guarantee my freedom and I refuse to let them die in vain.

The US Supreme Court disagrees. In fact, if it had been that way, it's unlikely any of the amendments prior to (approximate) standardization of spelling would have passed. (BTW, there is no provision for a "nay" vote to be passed to the Secretary, so you're wrong there, as well.)
As for the rest of your article: I'm not entirely sure the Income Tax is morally wrong, although I respect your opinion. Continuing:
Quote: Its America's lack of knowledge of our very own Constitution and the spirit of that Constitution that keeps us enslaved. The government doesn't need our tax money. Virtually all of the taxes collected each year goes to pay the national debt.
False, actually. I think interest payments are only 25% of the budget, and "surplus" (repayment of the debt) was only 10% even when we were repaying it.

All be the first two sentences of this paragraph are also refuted in the site mentioned above. The first two sentences are accurate, but misleading. I've given a reference in one of the two article threads listed here, but to summarize: The Federal Reserve is not part of the government, but is controlled by laws and the Federal Reserve Board, which is appointed by Presidents for 12- (or was it 14-)year terms. The US Post Office is also not part of the government, but what they can do is highly regulated by the government.
Re: LONG LIVE KARL MARX!
Arthur, the Federal Reserve Board and chairman may be appointed my the President/government, but it still doesn't make it right. This is the little bit of good, mixed in with the lie. It is a smoke screen.
Why hasn't the Federal Reserve Bank ever been audited? Why has it refused to be audited? Why is it above and beyond the law of the land?
Federal Reserve Banks are not listed in the government section of the phone books, they are in the regular white/yellow pages.
Please answer this question for me. What if the governemt signed the "Federal Express Act" and gave Federal Express the complete monopoly on the postal system in America?
Would you accept this? Would America accept this? What if Federal Express was never audited, and its employees never paid to have their mail sent.
We have had a very healthy discussion, but I feel I have said all I can. If you don't understand that you are just a slave to Congress and the Bankers, then there is nothing else I can say.
Good luck Arthur, and lets see how happy our decentants are in 50 years when the income tax is extracting 75 to 85% of their productivity. Remember, it started out as a mere 1% on incomes over $3000.00. Who are we to stop it? The government keeps growing and growing and growing and there is no effort being made to stop the growth. So, in order to pay for that ever expanding government, Congress will borrow more and more from the bankers, and then make us pay for it with ever growing income tax rates.
There are only so many units to a dollar, and with the combined federal, state, and local taxes, 75% of each dollar is already gone. We really are a pathetic people to let this happen.
So long all. I hope some learned something from all of this.
Quote: Why hasn't the Federal Reserve Bank ever been audited? Why has it refused to be audited? Why is it above and beyond the law of the land?
Why should it be audited? It isn't a bank!
Quote: Federal Reserve Banks are not listed in the government section of the phone books, they are in the regular white/yellow pages.
A point. The Post Office is listed in the government section, even though it isn't part of the government.

Couldn't be much worse than what we have now. However, the employees of the FRB don't have any specific benefits in banking. The Banks which are members of Federal Reserve Banks do.

www.taxplanet.com/library...rates.html shows that the top rate started at 7%, had been 94% in 1944-1945, was generally 70% (with some peaks up) through 1981, went down to 50% in 1982, 28% in 1988, and back up to 31% in 1991 and 39.6% in 1993. It's now (not shown in that table) 38.6%. It can go down.

I tend to agree -- we must fight to decrease the size of government outgo and income. On the other hand, borrowing money is better than printing money.
Here you have a banking corporation that prints money at will, with no backing of precious metal as required by the Constitution, they set interest rates, and control the economy to enrich their own pockets, and yet, you feel they should escape an audit?
It truly bothers me that a fellow American can think this way.
So, with this mind set, I hope you have no ill feelings against the oil companies, ENRON, Arthur Anderson, and Microsoft.
I used to wonder how tyrants can take over a society and get away with it, but I wonder no more. There are people that approve and let it happen.
Defense of thievery comes in many different excuses and reasons. You must be in the banking industry, government employee...or let me guess......a CPA.
